Putting your dispute in writing, sent by tracked post, creates a clear record that you challenged the debt from the outset.
What is a CCA request?
A CCA (Consumer Credit Act) request is a formal written request asking a creditor or debt collector to prove a debt is enforceable, usually by providing a copy of the original credit agreement. It's often called a 'prove the debt' letter.
How long does a creditor have to respond to a debt dispute letter?
Under the Consumer Credit Act 1974, a creditor generally has 12 working days to provide the requested documents. If they fail to do so, the debt is treated as unenforceable while the default continues, though this doesn't cancel the debt itself.
What is a statute-barred debt?
A debt becomes statute-barred, in England, Wales and Northern Ireland, if 6 years pass with no payment made and no written acknowledgement of the debt by you, and the creditor hasn't taken you to court. After that point it generally can't be enforced through the courts, but it can still legally exist and appear on your credit report.
